The red flag rule was added to FACTA to help prevent identity theft by creating policies to detect possible fraud. The ABA has successfully argued that they should not be required to implement the rule.  The change comes in the Red Flag Program Clarification Act of 2010.

This is another example of special interest groups winning over the common interest of the citizens. For shame ABA.
